By accessing or using the Site, submitting a registration inquiry, or enrolling your child in the League, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), are the parent or legal guardian of the athlete you are registering, have the legal authority to enter into this agreement, and accept these Terms on behalf of yourself and your child.

2. Description of Services

New Braunfels Under The Lights Flag Football is a youth non-contact flag football league serving the New Braunfels, Texas area. The League offers:

• Coed divisions for Pre-K through 8th grade

• All-Girls divisions for 3rd–5th grade and 6th–8th grade

• 6v6 flag football in a 7–8 week season format

• Jersey and shorts provided with each registration

• Opportunities to compete at the national level

The Site is used to collect contact information from interested parents and guardians and to distribute schedule and registration information. Actual registration, payment, and enrollment may be processed through third-party platforms.

3. Registration Information

When you submit your information through the Site, you agree to:

• Provide accurate, current, and complete information, including your name, email address, and phone number (if provided)

• Update your information promptly if it changes

• Consent to receive email communications regarding the League schedule, registration openings, and related updates

• Consent to receive SMS/text messages if you provide your phone number and opt in to text alerts

We reserve the right to refuse service, cancel registrations, or remove participants at our discretion.

4. League Participation and Code of Conduct

By registering an athlete for the League, you agree that:

• All participants, parents, guardians, coaches, and spectators will conduct themselves in a respectful and sportsmanlike manner at all times

• Harassment, bullying, threatening behavior, discrimination, or abuse of any kind toward players, coaches, officials, or other attendees will not be tolerated and may result in immediate removal from the League without refund

• Athletes must abide by all League rules, game rules, and instructions from coaches and officials

• Parents and guardians are responsible for the behavior of their children and guests at all League events

• We reserve the right to suspend or remove any participant or family from the League for violations of this code of conduct

5. Assumption of Risk, Waiver, and Release of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Participation in flag football involves inherent risks of physical injury, including but not limited to sprains, fractures, concussions, and other injuries. By registering your child for the League, you:

• Acknowledge and accept all risks associated with flag football participation, including risks arising from the negligence of others

• Voluntarily assume all risks of injury to your child arising from participation in the League

• Release, waive, and discharge New Braunfels Under The Lights Flag Football, its organizers, coaches, volunteers, sponsors, and affiliates from any and all claims, liabilities, demands, or causes of action arising out of or related to your child’s participation in League activities, including claims for personal injury, property damage, or death

• Agree to indemnify and hold harmless the League and its representatives from any claims brought by third parties arising out of your or your child’s conduct

This waiver applies to the fullest extent permitted by applicable Texas law.

6. Photography and Media Release

By registering for the League, you grant New Braunfels Under The Lights Flag Football the non-exclusive, royalty-free right to photograph, film, or record your child during League activities and to use such images or footage for promotional, educational, or marketing purposes, including on social media, websites, and printed materials. If you do not consent to this use, please notify us in writing prior to the start of the season.

7. Registration Fees, Refunds, and Cancellations

Registration fees, payment schedules, and refund policies will be communicated at the time of formal registration. General terms include:

• Fees must be paid in full by the deadline specified at registration

• Refund requests submitted prior to the season start date may be considered on a case-by-case basis

• No refunds will be issued once the season has begun, except at our sole discretion

• We reserve the right to cancel or reschedule events due to weather, safety concerns, or other circumstances beyond our control. No refunds will be issued for weather-related cancellations, though make-up games will be scheduled where possible

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and data, is the property of New Braunfels Under The Lights Flag Football or its content suppliers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our express written permission.

9. Third-Party Platforms and Links

The Site is built on or integrates with third-party platforms including LeadConnector/HighLevel and Google Tag Manager. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services. Links to external websites are provided for convenience only and do not constitute our endorsement of those sites.

THE SITE AND ALL INFORMATION PROVIDED THROUGH IT ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEW BRAUNFELS UNDER THE LIGHTS FLAG FOOTBALL, ITS ORGANIZERS, OFFICERS, VOLUNTEERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PARTICIPATION IN THE LEAGUE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the League shall be resolved first through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Comal County, Texas, in accordance with the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will post the updated Terms on the Site with a new effective date. Your continued use of the Site or participation in the League after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
